body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of November Ann Dom One thousand Seven hundred and thirty Six to answer unto Alexander Buncle of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which day here Came before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Alexander Buncle by Geo: Douglas his attorney and the sheriff of the same County to witt Joseph M.ccClester Gen.t at the same day have here returned that he had taken the af.d Francis Porter whose body here at this day he had ready to answer unto the af.d Alexander Buncle of the af.d plea as to him it was Commanded &.c Whereupon a Certain Littleton Townsend of Somerset County planter Came here into Court before the aforesaid Justices and undertook for the Said Francis Porter and assumed upon himselfe (likewise the same Francis Porter present herein Court in his proper person assumed upon himself) that if it should ^happen that Judgm.t in the plea afd should^ be rendred for the same Alexand Buncle against him the said Francis Porter or that he the said Francis should be therein Convicted that then he the said Francis shall pay and satisfie unto the said Alexander ^Buncle^ the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison th of the sheriff of the County af.d thereto remain untill the same Judgment be fully satisfied or that the said Littleton Townsend will do the same for him And hereupon the Same Alexander Buncle declared against the said Francis Porter in the plea aforesaid in form following Somerset County ss Francis Porter late of Somerset County planter was attached to answer unto Alexander Buncle of a plea of trespass upon the Case &c And whereupon the said Alexander Buncle by Geo: Douglas his attorney Complains that whereas the said Alexander and the said Francis on the nineteenth day of Aug.t Anno Dom seventeen hundred thirty and six at the County af.d within the Jurisdiction of this Court did account together for sundry sums of tobacco by the said Francis to the said Alexander before that time due and unpaid and upon that account the said Francis was found in arre^a^r and indebted to the said Alexander the quantity of three thousand two hundred forty and five pounds of tobacco and being so thereof in arrear and indebted found the said Francis afterwards to witt the day day and |
