    March Court               1736                35

And whereupon the said Henry Jerman in his own proper person at the same day Cometh & defendeth the force &
Injury when &c and saith that he Cannot deny the action afd of the afd John Atkinson nor but that he did assume upon
himselfe in manner and form as the afd John above against him hath Complained and as to the damages of the
same John by him by Occasion of the premisses in that part Sustained the same Henry saith and acknowledgeth that
the afd John hath Sustained damages by occasion of the premisses beyound his Costs and Charges by him about his
Suit in that part apposed to Ninteen pounds thirteen Shillings & Eleven pence three farthings Curr.t money of
Maryland and not more and because the afd John denys not this but believes the same allegation to be true
prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him
to be adjudged &c
                                     Therefore by Consent of the parties afd it is Considered that the afd John Atkinson
recover against the afd Henry Jerman his damages afd to the afd Ninteen pounds thirteen shillings & Eleven
pence three farthings Curr.t money of Maryland in form afd acknowledged as also three hundred & Ninty five
373                                                    pounds of tobacco for his Costs and Charges afd to the same John at his
his request by the Court here of the assent of the parties afd adjudged which damages in the whole do amount
to Nineteen pounds thirteen Shillings & Eleven pence three farthings Curr.t money of Maryland & three hundred
& Ninety five                                                      pounds of tobacco & the afd Henry in Mercy &c
