389    tobacco in form af.d acknowledged as also: four hundred & Eleven
pounds of tobacco for his Costs and Charges af.d to the same James at his request by the Court here ^of^ the
assent of the parties af.d adjudged which Certain damages in the whole do amount to: three thousand
five hundred & one                    : pounds of tobacco and the af.d Joseph in mercy &c

     Command was given to the Sheriffe of Somerset County that he should take Henry
Jerman Late of Somerset County planter if he Should be found in his bailywick and him should
safe keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held ^in the Court house^ at dividing Creek the third Tuesday of November Ann Dom One thousand
seven hundred and thirty Six to answer unto John Atkinson of a plea of trespass upon the Case &c
and that thereof he Should not fail &c         Att which day here before the Justices of his Lordships County
Court of Somerset at dividing Creek Came the said John Atkinson by Francis Allen his attorney and the
sheriff of the same County here returned that he had taken the afd Henry Jerman whose body here at this day he
had ready to answer the afd John Atkinson of the afd plea as to him it was Commanded and the said Sheriffe at
the Same day altho Solemnly Called brings not in the body of the Same Henry Jerman according to the return of
the writt afd  thereupon the said Sheriff to witt Joseph MccClester Gent is amerciaed ^by the Court here^ unto his said Lordship the
the Lord proprietary for his default afd three Shillings and four pence Curr.t money unless he the said Sher
hath the said Henry Jerman before the Justices of his ^said^ Lordships County Court of Somerset at dividing Creek
the third Tuesday of March then next following and the same day is Given to the afd John Atkinson there &c

Att which day here before his said Lordships Justices at dividing Creek Came the said John Atkinson by his
attorney afd and hereupon the said John declared against the afd Henry in the plea afd in form following

                               Somerset County sst  Henry Herman late of Somerset County planter was
attached to answer unto John Atkinson of a plea of trespass upon the Case &c

And Whereupon the said John by Francis Allen his attorney Complains that whereas the
the said Henry the Eleventh day of February Anno Dom one thousand seven hundred and
thirty Five six at the County of Somerset af.d within the Jurisdiction of this Court was
Indebted unto the said John in the sum of twenty three pounds five shillings and nine
pence three farthings Curr.t money of Maryland for sundry properly chargeable in acc.t
as by acc.t thereof here unto annexed may in Court appear and being so thereof Indebted the
said Henry the day and year af.d at the County af.d in  Consideration thereof upon himselfe
