33 hath refused and still doth refuse to the damage of the same Richard three thousand three hundred pounds of tobacco and one pounds sixteen shillings Curr.t money of Maryland thereupo he bringeth suit &c Pledges &c John Doe & R Roe And Whereupon the said Joseph M.ccClester in his proper person Comes and defends the force and Injury when &c and saith that he Cannot deny the action af.d of the af.d Richard Davis nor but that he did assume upon himself in manner and form as the af.d Richard above against him hath Complained and as to the damage of the same Richard by him by Occasion of the premisses in that part sustained the same Joseph saith and Acknowledged that the af.d Richard hath sustained damages by Occasion of the premises beyond his Cost and Charges by him about his suit in that part apposed to sixteen hundred and thirty one pounds of tobacco and eighteen shillings Curr.t money of Maryland and not more and because the af.d Richard denys not this but the same allegation beleives to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d Richard Davies recover against the af.d Joseph M.ccClester his damages af.d to the af.d sixteen hundred and thirty one pounds of tobacco and eighteen shillings Curr.t money of Maryland in form af.d 283 acknowledged as also: three hundred & five : pounds of tobacco for his Cost and Charges af.d to the same Richard at his request by the Court being of the assent of the parties af.d adjudged which Certain damages in the whole do amount to Eighteen po shillings Currt Money & Nineteen hundred & thirty Six : pounds of tobacco and the af.d Joseph in mercy &c
Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek in the Same County the third Tuesday of november anno Dom One thousand seven hundred and thirty six to answer unto James Hays of a plea of trespass upon the Case &c and that thereof they should not fail &c Att which day here before the Justices of his Lordships County Court of Somerset at Dividing Creek Came the afd James Hays by William Goldsborough his attorney and the Coroners of the same County to witt Henry Ballard & Wm Lane Gent returned that they had taken the afd Joseph Macclester whose body here at this day they have here ready to answer the |
