32 of the premises in that part sustained the same Joseph saith and acknowledgeth that the af.d Richard hath sustained damages by Occasion of the premises beyond his Cost and Charges by him about his suit in that part apposed to seven thousand pounds of tobacco and not more and because the af.d Richard denys not this but the same allegation bleives to be true prays Judgment for those damages above acknowledged together with his Cost and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d Richard Gildart recover against the af.d Joseph MccClester his damages af.d to the af.d seven thousand pounds of tobacco in form af.d acknowledged as also four hundred & Eleven pounds of tobacco for his Cost and Charges af.d to the same Richard at his request by the Court here of the assent of the parties af.d adjudged which Certain damages in the whole do account to 389 seven thousand four hundred & Eleven pounds of tobacco and the aforesaid Joseph in Merch &c
Creek in the same County the third tuesday of November Anno Dom one thousand seven hundred and thirty six to answer unto Richard Davis of a plea of trespass upon the Case &c and that thereof they should not fail &c Att which day here Came before the Justices of his Lordships County Court of Somerset at dividing Creek Came the af.d Richard Davis by William Goldsborough his attorney and the Coroners of the same County here returned that they had taken the af.d Joseph MccClester whose body here at this say they have ready to answer the af.d Richard Davis of the af.d plea as to them it was Commanded Whereupon a Certain William Beckingham and Geo Douglas of Somerset County Gen.t in their proper persons here Came before the af.d Justices and undertook and each of them undertook for the same Joseph MccClester and assumed upon themselves (Lickwise the same Joseph MccClester present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d in the same Court should be rendred for the same Richard Davies against him the said Joseph MccClester that |
