31 to answer unto Richard Gildart Esq.r of a plea of trespass upon the Case &.c and that thereof they should not fail &a Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd Richard Gildart by William Goldsborough his attorney and the Corners of the same County here returned that they had taken the afd Joseph Macclester whose body here at this day they have ready to answer the afd Richard Gildart of the afd plea as to them it was Commanded Whereupon a Certain William Beckingham and George Douglas of Somerset County Gent in their proper persons ^here Came^ before the afd Justices and undertook and Each of them undertook for the same Joseph Macclester and assumed upon themselves (Likewise the same Joseph Macclester present here in Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea af.d in the same Court should be Rendred for the same Richard Gildart against him the said Joseph MccClester or that he the said Joseph MccClester should be therein Convicted that then he the said Joseph MccClester should pay and Satisfie unto the said Richard Gildart the Judgment of the Court thereupon or Render his body in Execution of such Judgment to the prison of the County af.d thereto Remain untill the same Judgm.t be fully Satisfied unto the same Richard or that they the same William Beckingham & Geo Douglas will do the same for him And Whereupon the same Joseph MccClester puts in his place William Beckingham ^Gent^ against the af.d Richard Gildart of the plea af.d and upon this day is given to the parties here before the Justices of his Lordships County Court of Somerset untill the third tuesday of March then next following in the State wherein they now are saving to ^the parties afd^ &c Att which day here Came againe as well the af.d Richard Gildart as the af.d Joseph MccClester by their attorneys af.d and hereupon the same Richard Gildart declared against the said Joseph MccClester in the plea af.d in form following Somerset County ss.t Joseph MccClester late of Somerset County Gen.t was attached to answer unto Richard Gildart Esq.r of a plea of trespass upon the Case &c And Whereupon the same Richard by William Gouldsborough his attorney complaineth that whereas a certain William Beckingham the eighteenth day of February in the year of our Lord God seventeen hundred thirty and five at Somerset County af.d (the same William Beckingham then and there negotiating and Comerce useing) his certain bill in writing According to the use and Custom of Merchants from time whereof the memory of man is not to the contrary used and approved did not make and with his proper hand subscribe bearing date the |
