before his Lordships Justices untill next Court to be held at dividing Creek in and for the County afd the
third Tuesday of June then next following and then to replay  &a    Att which day here Came againe as
well the Aforesaid Tench Francis ^by his attorney afd^ as the afd Thomas Watkins in his proper person  And Whereupon the afd Tench
then and there his writt afd against the afd Thomas did not prosecute with Effect but voluntarily suffered his
suit to be discontinued   Therefore afterwards to witt that Same day by discretion of the Justices here were
adjudged the Sames Thomas Watkins                                                                                          pounds
178   of tob.o for his Costs and Charges afd by him about his ^defence^ Suit in that part sustained according to the form of the
Statute in such Case thereupon Lately made and provided and the afd Tench in mercy  and that the afd
Thomas have thereof his Execution &a

 Command was given to the sherriffe of Somerset County
that he should take Thomas Watkins Late of Somerset
County Merchant if he should be found in his bailywick
and him should safe keep so that he might have his body before the Justices
of his Lordships County Court of Somerset to be held at deviding Creek in the
same County the third tuesday of June Anno Dom one thousand seven hundred
and thirty eight to answer unto Richard Gildart Esq.r of a plea of
trespass upon the Case &.a  and the same day is given to the af.d Richard
there &.a   Att which day here before his Lordships Justices at a Court then
held at deviding Creek Came the af.d Richard by William Goldsborough
his attorney and the sherriffe of Somerset County to witt John Henry Gent
now here returned that he had taken that he had taken the af.d Thomas
Watkins whose body hereat this day he had ready to answer the af.d
Richard of the af.d plea as to him it was Commanded

Whereupon the afd Thomas Watkins by Robert Jenkins Henry his attorney Comes and defends the
force and Injury when &a and thereupon the said Richard Gildart then and there his writt afd against the
the afd Thomas Watkins did not prosecute with Effect but Voluntarily Suffered his Suit to be discontinued &a

             Therefore afterwards to witt that same day by direction of the Justices
here were adjudged the same Thomas Watkins
