289 any part thereof unto the same Whittington have not paid nor hath either of them paid but that unto him to pay the af.d Benjamin in his lifetime and the af.d Capell after the death of the said Benj.a to pay still still doth refuse and unjustly detain to the damage of the same Whittington seven thousand pounds of tobacco and fourteen pounds Currt money and thereof he bringeth suit &.a Pledges &a John Doe & Richard Roe A Copy of the foregoing decleration was made and sent to be served on the deft with the writt aforesaid according to act of assembly in such case provided Att which day here before his Lordships Justices at a Court then held at deviding Creek Came the af.d Whittington King by his attorney af.d and the sheriffe of Somerset County to witt John Henry Gent now here returned that he had taken the af.d Capell King whose body hereat this day he had ready to answer the af.d Whittington King of the afd plea as to him it was Commanded and further the same sherriffe returned that he had seved served the same Capell King with a Copy of the decleration af.d according to act of assembly in such case provided &a And the af.d Capell King by George Douglas his attorney Cometh and defendeth the force and Injury when &a and prayeth Leave thereof to Imparle here untill the next Court to be held at deviding Creek in and for the County af.d the third tuesday of March then next following and he hath it and the same day is given to the af.d Whittington here also &a Att which day here Came againe as well the afd Whittington as the af.d Capell by their attorneys af.d and Whereupon the same Capell prayeth further Leave thereof to Imparle here untill the next Court to be held at deviding Creek in and for the County af.d the third tuesday of June then next following and he hath it and the same day is given to the af.d Whittington here also &.a Att |
