277 thereupon or Render his body in Execution of Such Judgmt to the prison of the Sheriffe of the County ^afd^ thereto remain untill the Same Judgment should be fully satisfied or that he the afd John Bowen will do the same for him &a And the aforesaid Charles Rackiffe by Francis Allen his attorney Comes and defends the force and Injury when &.a and saith that he Cannot deny the action afd of the aforesaid Duncan nor but that he did assume upon himselfe in manner and form as the afd Duncan above against him hath Complained and as to the damage of the same Duncan by him by occasion of the premisses in that part sustained the same Charles saith and acknowledgeth that the afd Duncan hath Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to five pounds nineteen Shillings and nine pence Curr.t money of Maryland and not more and because the afd Duncan denys not this but the same allegation believes to be true prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Duncan Murray recover against the aforesaid Charles Rackliffe his damages afd to the afd five pounds Nineteen Shillings and nine pence Curr.t Money of Maryland by the Same Charles Rackliffe in form afd acknowledged 353 as also pounds of tobacco 353 for his Costs and Charges afd to the Same Duncan at his request by the Court now here of the assent of the parties afd adjudged with Stay of Execution untill the twentieth day of November then next following and the afd Charles in Mercy &a
he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of June ann Dom One thousand Seven hundred and thirty Eight to answer unto Abraham Outen of a plea of trespass upon the Case &a and the same day is given to the afd Abraham there also &a And ^hereupon^ the afd Abraham Outen declared against the afd Richard in the plea afd in form following Somerset ss.t Richard Hubbard Late of Somerset County Bricklayer was attached to answer unto Abraham Outten of a plea of trespass |
