said Days haveing them so repacked as af.d and altho the said Day hath paid
to the said Benjamin the af.d sum of twenty four pounds paper money as af.d
and eight pounds in Gold as af.d and the said sixteen Barrells of pork upon
delivery and view thereof were not nor either of them was full and well packed
and a sufficient and usual quantity of neat pork therein contained but instead
thereof in each Barrell of the said Pork was contained a large and unusual
quantity of salt  Nevertheless the said Benjamin his promise and assumption
af.d in form af.d made nothing regarding but minding and fraudulently
Intending the said Day in that part to deceive and defraud the said sixteen
Barrells of pork so defective in the severall particulars af.d to suffer or permitt
the said Day so to repack as af.d he the said Benjamin did absolutely refuse and
any part of the said sum of money by the said Day to the said Benjamin in
manner af.d paid the said Benjamin to refund or repay to the said Day according
to his promise and assumption af.d hath altogether refused and still doth refuse
that the said Day is thereby much hurt and damnifyed  Whereupon the said
Day saith he is the worse and hath damage to the value of fifty pounds Curr.t
money of maryland and thereupon he brings suit &a   Pledges &a  J Doe & R Roe

       And the aforesaid Benjamin Townsend by his attorney afd Comes and defends
the force and Injury when &.a and prayeth Leave thereof to Imparle hereuntill the
next Court to be held at dividing Creek in and for the County aforesaid ^the^ third Tuesday
of November then next following and he hath it and the Same day is given to the
afd Day here also &.a  Att which day ^here^ Came againe as well the af.d Day Scott
as the af.d Benjamin Townsend by their attorneys af.d  And whereupon
the said Benjamin Townsend prays further Leave thereof to Imparle here
untill the next Court to be held at deviding Creek in and for the County af.d the
third tuesday of March then next following and he hath it and the same day is
given to the af.d Day here also &.a    Att which day here Came againe as well
the af.d Day Scott as the af.d Benjamin Townsend by their attorneys af.d and
whereupon the same Benjamin as before defends the force and Injury when &.c
and saith that he did not assume upon himself in such manner and form as the af.d
Day above against him hath declared and of this he puts himself upon the
Country            And the said Day Scott in like manner                   thereupon
