237 of the def.t Holland or any Memorandum thereof was reduced to writing and signed by the said Holland or any person by him thereto lawfully Impowered according to the form of the statute in that case lately made and provided Whereupon all and Singular the premises by the Court here Seen heard and fully understood it seems to the Justices here that the reasons afd and the matter therein Contained are not Sufficient in Law to barr or preclude the afd John Lay from having of Judgm.t on the verdict afd so as afd on part of him rendered Therefore it is Considered that the afd John Lay recover against the afd Thomas Thomas Collins and Nehemiah Holland the damages afd by the Jurors afd in form afd assessed as also eight hundred and Two pounds of tobacco for his Costs and Charges afd to the same John Lay by the Court hereof his assent of Increase adjudged which same Damages in the whole amount to Nine pounds three shillings Currt money of Maryland and Eight hundred and three pounds of tobacco and the afd Thomas and Nehemiah in mercy &a
Court of Somerset to be held at deviding Creek in the same County the third tuesday of June Anno Dom one thousand seven hundred and thirty seven to answer unto Day Scott of a plea of trespass upon the Case &.a and the same day is given to the af.d Day here &.a Att which day here before his Lordships Justices at a Court then held at deviding Creek in the same County Came the af.d Day Scott by Robert Jenckins Henry his attorney and the af.d sherriffe to witt Joseph Macclester Gent now here returned that he had taken the af.d Benjamin Townsend whose body hereat this day he had ready to answer the af.d Day Scott of the af.d plea as to him it was Commanded And Whereupon the af.d Benjamin Townsend puts in his place Charles Goldsborough Gent against the af.d Day Scott in |
