213 Justices in Court then held at dividing Creek in the County afd Came the afd Emond Hough by his attorney aforesaid and the Sheriffe to witt John Henry Gent now here returned that he had taken the afd William Porter whose body here at this day he had ready to answer the afd Edmond Hough of the plea aforesaid as to him it was Commanded and further the Same Sheriffe returned that he had Served the same William Porter with a Copy of the declaration afd according to act of assembly in such Case made and provided &.a Whereupon Came here into Court before the afd Justices John Wildman of Somerset County Inholder in his proper person and undertook for the afd William Porter and assumed upon himselfe (Likewise the Same William Porter present herein Court in his proper person assumed upon himselfe) that if it Should happen that Judgment in the plea afd should be rendered for the Same Edmond Hough against him the same William Porter or that he the Same William Porter Should be therein Convicted that then he the said William Porter Should pay and Satisfie unto the same Edmond Hough the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriffe of the County afd thereto remain untill the Same Judgment Should be fully Satisfied or that he the afd John Wildman will do the Same for him &a Whereupon the said Edmond Hough and William Porter both present here in Court in their proper persons Submitted their dispute in this action to the award of Robert King Esqr according to the form of the Statute and that he make his return thereof in the premise above said between the parties Immediately that the Court might proceed to Judgm.t thereon and afterwards in the Same Court before the Justices thereof Came the afd Robert King Esq.r the person to whom the aforesaid Submission was made and return'd his award in form following Rec.d by W.m Porter of M.r Hough £17..13..0 paid M.r Hough Back by W.m Porter 10.. Ball due to E H £17.. 3 for which W.m Porter is to give Security for payment within a year with Lawfull Interest untill paydent W.m Porter is to pay his own attorney and all Costs Except M.r Houghs attorney and two Wittnesses Sumoned by him he is to pay Robt King Which being read and heard It is Considered that the afd Edmund Hough recover against the afd William Porter the damages afd to the afd Seventeen pounds three shillings as by the 329 Award aforesaid appears as also Three hundred and Twenty Nine pounds of tobacco for his Costs and Charges afd to the same Edmund by the Court here of his assent adjudged and the afd William in Mercy &a
