19 And afterwards in the same Court before the Justices thereof Came John Dennis Jun.r Late of Somerset County Inholder in his proper person and undertook for the Same William Lewis and assumed upon himselfe [Likewise the same Wm Lewis present herein Court in his proper person assumed upon himselfe] that if it should Happen that Judgment in the plea afd in the same Court Should be rendered for the same Daniel Carroll against him the said William Lewis or that he the said William Lewis Should be therein Convicted that then he the said William Lewis should pay and Satisife unto the afd Daniel Carroll the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriffe of the County afd thereto remain untill the SAme Judgment be Satisfied unto the Same Daniel Carroll or that he the Said John Dennis Jun.r will do the same for him Thereupon the said William Lewis in his proper person Cometh & defendeth the force & Injury when &c and upon this day is Given to the parties afd here untill the third Tuesday of June then next following &c Att which day here Came againe as well the afd Daniel Carroll by his attorney afd as the afd William Lewis in his proper person and Whereupon the afd John Dennis Jun.r bail of the afd William Lewis ^likewise^ being present herein Court before the Justices thereof delivers upon unto the Same Court the Body of the Same William Lewis in discharge of his recognizance of Bail af.d Entered into as afd for the afd William Thereupon at the prayer of the afd Daniel Carroll by his attorney afd the afd William Lewis is adjudged by the Justices afd here to give other bail to the action afd unto the same Daniel Carroll but for want thereof the Same William Lewis is Committed by the same Justices here into the Custody of the sheriff of the County afd thereto remain &c untill &c the same Sheriffe to witt Joseph MccClester Gent present herein Court by Francis Porter his deputy took Charge of the Same William Lewis accordingly and thereupon further day of given to the parties afd here untill the third tuesday of august then next following &c Att which day here before the the Justices of his Lordships County Court of Somerset at dividing Creek Came againe as well the afd Daniel Carroll by his attorney aforesaid as the afd William Lewis in Custody ^of the Sheriffe^ as afd in his proper person and thereupon further day is given to the parties afd untill the third Tuesday of November then next following &c Att which day before the Justices of his Lordships County Court of Somerset at dividing Creek Came here againe as well the afd Daniel Carroll by his attorney afd as the afd W.m Lewis in his proper person in Custody of the Sheriffe afd and thereupon the said Daniel Carroll declared against the said William Lewis (in Custody as afd) upon the Writt afd viz.t Somerset County sst William Lewis late of Somerset County planter otherwise Called William Lewis now of Somerset County planter was sumoned to answer unto Daniel Carroll of a plea that he render unto him forty two pounds Curr.t money of Maryland which to him he oweth and unjustly detaineth &c And whereupon the same Daniel by William Beckingham his attorney saith that whereas the af.d William Lewis the ninth day of october Anno Dom seventeen hundred thirty and one at |
