17 province af.d which unto him he oweth and unjustly detaineth &c And Whereupon the same Thomas Fletcher by William Beckingham his attorney saith that whereas the af.d Thomas Lambden the second day of february in the year of our Lord God seventeen hundred and thirty six at Somerset County af.d by his certain writing obligatory had granted himself to be bound unto the af.d Thomas Fletcher in the af.d sum of two hundred pounds Curr.t money of the province af.d to be paid unto the same Thomas Fletcher when thereof afterwards he should be required Nevertheless the af.d Thomas Lambden altho often required the af.d sum of money or any penny thereof unto the af.d Tho.s Fletcher hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same Thomas Fletcher three hundred pound like money and therefore he bringeth suit &c and doth bring hereinto Court the writing obligatory af.d which the debt af.d in form af.d doth testify the date whereof is the same day and year af.d &c Pledges &c Jno Doe & R Roe And the af.d Thomas Lambden by William Goldsborough his attorney Cometh and defendeth the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Thomas Fletcher nor but the writing obligatory af.d is the deed of the same Thomas Lambden nor but that he oweth the same Thomas Fletcher the af.d two hundred pounds Curr.t money of Maryland in manner and form as ^the^ af.d Thomas Fletcher above against him declared Therefore it is Considered that the af.d Thomas Fletcher recover against the af.d Thomas Lambden his debt af.d and his damages by occasion of the detaining of the same debt to two hundred and ninety nine pounds of tobacco to the same Thomas Fletcher of his assent by the Court here adjudged and the af.d Thomas Lambden in mercy &c
Tobacco which unto him he Oweth and Unjustly detaineth &c And whereupon the Same Richard by William Goldsborough his attorney saith whereas the af.d William Wye the twenty first day of June Anno Dom seventeen hundred thirty and six at Somerset County af.d by his Certain writing obligatory had granted himself to be bound unto the af.d Richard in the af.d sum of twenty two thousand four hundred and fifty pounds of Marchantable tobacco to be paid unto the same Rich.d when thereof |
