154 and Charges afd to him to be adjudged &.a Therefore it is Considered by Consent of the parties aforesaid that the aforesaid John Lewis recover against the afd William Kitchen his damages aforesaid to the aforesaid thirty two pounds thirteen Shillings and five pence halfe penny Sterling by the same William in form afd acknowledged as also four hundred 414 and thirty Six pounds of tobacco for his Costs and Charges afd to the same John at his request by the Court now here of the assent of the parties afd adjudged which Certain damages in the whole amounts to thirty two pounds thirteen Shillings and five pence halfe penny Sterling and four hundred & thirty Six pounds of tobacco with stay of Execution till the first day of January then next following and ye afd William in mercy &a
keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of Novem Ann Dom One thousand seven hundred and thirty Seven to answer unto John Caldwell of a plea of trespass upon the Case &a And hereupon the said John Caldwell declared against the afd James Townsend in the plea afd in form following vizt Somerset ss.t James Townsend late of Somerset County planter was attached to answer unto John Caldwell of a plea of trespass upon the Case &a And Whereupon the said John Caldwell by Geo Douglas his attorney Complains that whereas the said James after the first day of May Anno Dom Seventeen hundred and five to witt on the eighteenth day of november Anno Dom seventeen hundred thirty and six at the County af.d did make his certain note in writing called a promisary note with his proper hand subscribed bearing date the day and year last af.d and the same note to the said John Caldwell then and there did deliver by which note the said James ^did^ oblige himself or promise to pay unto the said John eleven hundred and forty pounds of tobacco either in pork at pound for pound or in Curr.t money of maryland at twelve shillings and six pence p hundred on or before the first day of march next ensuing |
