14 that by the oath of honest and Lawfull men of their County they diligently Inquire what damage the same Joshua hath sustained as well by Occasion of the non performance of the promise and assumption af.d as for his Costs and Charges by him about his suit in that part apposed and the Inquisition which thereupon they take they make appear to the Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek in the same County the third tuesday of November ^then^ Next Following under their seals and the seals of those by whose ^oath^ they take that same Inquisition they send together with his Lordship Writt thereof to him directed and the same day is given to the af.d Joshua there &c Att which day before the Justices of his Lordships County Court of Somerset at dividing Creek Cometh the af.d Joshua Caldwell by his attorney af.d and the Coroners to witt William Lane and Henry Ballard Gen.t Coroners of the County of Somerset af.d Returned a Certain Inquisition before them at dividing Creek at the Court house in the County af.d the fifteenth day of March Anno Dom one thousand seven hundred and thirty six by the oath of honest and Lawfull men of their County takes by which it is found that the af.d Joshua hath sustained damages by occasion of the nonperformance of the promise and assumption af.d beyond his Cost and Charges by him about his suit in that part apposed to twenty three pounds twelve shillings and four pence Curr.t money of Maryland and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the af.d Joshua Caldwell recover against the af.d Joseph MccClester his damages af.d by the Inquisition af.d found also Eleven hundred and Eighty One 1159 pounds of tobacco for his Costs and Charges by him about his suit in that part apposed to the same Joshua by the Court here at his request ^of^ Increase adjudged with Certain damages in the whole do amount to twenty three pounds twelve shillings and four pence Curr.t money of Maryland and Eleven hundred and Eighty two 1160 pounds of tobacco with stay of Execution untill the first day of May then next following and the af.d Joseph in mercy &c
before the Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek in the same County the third Tuesday of March then next following to answer unto William Sandwith of a plea of trespass upon the Case &c and that thereof not fail &c and hereupon the said William Sandwith declared against the afd Ebenezer Crapper in the plea afd as followeth viz.t Somerset |
