 Somerset ss.t    Joseph MccClester late of Somerset County Gentleman was
attached to answer unto Joshua Caldwell of a plea of trespass upon the Case
&c
And Whereupon the said Joshua by Geo: Douglas his attorney complains that whereas
the said Joseph on the tenth day of may Anno Dom seventeen hundred and thirty five at the
County af.d within the Jurisdiction of this Court was indebted to the said Joshua in the sum of six
thousand two hundred and twenty four pounds of tobacco for Levy and sundry other matters
and things properly lying in account as by an account thereof herewith into Court brought
and hereto annexed may appear and being so thereof indebted on Consideration thereof
upon himself did assume and to the said Joshua then and there faithfully promise that he the
said Joseph the said six thousand two hundred and twenty four pounds of tobacco when afd
aftwards he should be thereto required he would faithfully pay and Content and altho the said
Joseph hath paid to the said Joshua twelve hundred pounds of tobacco part of the said six
thousand two hundred and twenty four pounds of tobacco Nevertheless as to five thousand and
twenty four pounds of tobacco Residue of the said six thousand two hundred and twenty four
pounds of tobacco the said Joseph his promise and assu^m^ption af.d in form af.d made nothing
regarding but minding and fraudulently intending the said Joshua in that part craftilly
and Subtilly to deceive and defraud the said five thousand and twenty four pounds of tobacco
to the said Joshua hath not paid or him for the same in any sort contented but the same to
him to pay hath altogether refused and still doth refuse altho that to doe afterwards to witt
the day and year af.d at the County af.d and often since that the said Joseph by the said Joshua
was required  Whereupon he says he is damnifyed fifty pounds Curr.t money of Maryland and
thereof he brings Suit &c                                                      Pledges &c   Jno Doe
