1735 79 bill as fully in all parts as if the same were here particularly interrogated & that the said George may by decree of this Court be Compelled to satisfie your Orators Just debt aforesaid and that your Orator may be reliev'd in the premisses according to Equity & Good Conscience may it please your Worships to grant your Orator his Lordships writt of Subpena to the said George Howard to be directed thereby commanding him at a Certain day & under a Certain pain therein to be limited personally to appear before your worships in Chancery to answer this your Orators bill & to stand by & abide such further order & decree in the premisses as to your Worships shall seem agreeable to equity & good Conscience & your orator shall pray
knowledge received any part or parcell of the money charged as due in the said Account or any Security or Satisfaction for the same more than the Credit Given sworn before me Jam.s Martin Thereupon Command was given to the Sheriff of Somerset County that he should sommons the said George Howard if he Should be found in his Bailywick that all Excuses set apart he should be and appear before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August then next to answer unto the afd John Hendry's Bill in equity &.a at which said next Court to witt the Ninteenth day of August anno Dom One thousand Seven hundred and thirty five Came againe the Said John Hendry by his attorney aforesaid and the Sheriff of Somerset County to witt Joseph MccClester Gent at the Same day returned that he had sumoned the afd George Howard as by the preceipt afd he was Commanded and whereupon afterwards to witt the same day and Year Last mentioned Came here into Court as well the afd John Hendry by his attorney afd as the said George Howard by Francis Allen his attorney and the Bill afd being read and heard and the Severall allegations as well of on the part of the said John Hendry as on the part of the Said Geo Howard fully and maturally deliberated it seems to the Justices here that the bill afd be dismist &a Therefore it is Considered that the afd John Hendry take nothing by his Bill afd but be thereof in mercy for his falce Clamour and that the said George Howard go thereof without day and also it 325 is Considered by the Justices here that the afd George Howard recover against the afd John Hendry 325 three hundred and twenty five pounds of tobacco for his Costs and Charges by him about |
