(77) damage of the s.d Joseph of Four thousand pounds of tobacco and thereupon he brings Suite &.a Pledges &.a Jn.o Doe & R Roe And the aforesaid Donnock Dennis for his own proper person cometh and defendeth the force and Injury when &.a and prays the leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the aforesaid Joseph herealso &.a Att which said next Court to witt the seventeenth day of June anno Dom One thousand seven hundred and thirty five Came againe as well the afd Joseph MaClester by his attorney afd as the afd Donnock dennis in his proper person and whereupon the said Donnock prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Joseph herealso &a Att which said next Court to witt the Ninteenth day of August Anno Dom One thousand Seven hundred and thirty five Came againe the said Joseph MaClester by his attorney afd and prays that the afd Donnock Dennis to his declaration aforesaid may answer but the same Donnock says nothing in barr or preclusion of the action afd of the aforesaid Joseph by which the Same Joseph remaineth against the afd Donnock thereof undefended &a Therefore it is Considered by the Court here that the aforesaid Joseph MaClester recover against the aforesaid Donnock Dennis his debt aforesaid and his damages Sustained by occasion 361 of the detaining of the Same debt to three hundred and Sixty One pounds of tobacco to the same Joseph by the Court here of his assent adjudged and the afd defend.t in mercy &a
And whereupon the s.d Joseph by Francis Allen his attorney saith that whereas the s.d Stanton the Ninth day of November Ann Dom Seventeen hundred & thirty four at Somerset County afores.d within the Jur of this Court by his certain writing obligatory w.ch the s.d Joseph with y.e seal of y.e s.d Stanton signed hereinto Court brings the date whereof is the same day & year did acknowledge himself to be bound unto the s.d Joseph in the afores.d Eight thousand pounds of tobacco to be paid unto the s.d Joseph when he should be thereunto required Yett the s.d Stanton tho' often required the s.d Eight thousand pounds of tobacco to the s.d Joseph hath not rendered but the same to him hitherto to render hath denied and still doth deny and unjustly detain to the damage of the s.d Joseph of four thousand pounds of tobacco and thereupon he brings Suite &a Pledges &.a Jn.o Doe & R Roe And the aforesaid Stanton Atkins in his own proper person cometh and defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Joseph herealso &.a (Att |
