And the aforesaid John Horsey by William Goldsborough his attorney Cometh and defendeth
the force and Injury when &.a and saith that he cannot gainsay the action afd of the afd Joshua
Caldwell nor Can he say but that the said William Horsey in his life time did assume upon himselfe
in such manner and form as the afd Joshua Caldwell above against him hath Complained
and as to the damage of the Same Joshua by him by Occasion of the premisses in that
part Sustained the same John saith and Confesseth that the afd Joshua hath Sustained
damages by occasion of the premisses beyound his Costs and Charges by him about his suit
in that part apposed to three thousand One hundred and twenty Eight pounds of tob.o
and not more and because the afd Joshua denys not this but the Same allegation Confesseth
to be true prays Judgment for those damages above Confessed together with his Costs and
Charges afd to him to be adjudged &a

       Therefore by Consent of the parties afd it is Considered that the afd Joshua Caldwell
recover against the said John Horsey Executor of the afd William Horsey dec.d his damages afd
to the afd three thousand One hundred and twenty ^Eight^ pounds of tobacco in form afd Confessed as
961   also Nine hundred and Sixty One                                                      pounds of tobacco for
his Costs and Charges afd to the Same Joshua Caldwell by the Court here and Consent of the parties
afd adjudged to be Levied of the goods and Chattells which were of the afd William
Horsey at the time of his death in the hands of the said John Horsey remaining to be administred
if so much in his hands he hath and if so much in his hands he hath not then the Costs afd
to be Levied of the proper goods and Chattells of the said John Horsey and the afd deft in Mercy &a

Command was given to the Sheriff of Somerset County that he
should take William Kitchen Late of Somerset County Marriner if
he should be found in his Bailywick and him should safe Keep so
    that he might have his body before Our Justices of Our County Court of Somerset to
    be held at dividing Creek the third tuesday of August then next to answer unto William
    Camplin of a plea of trespass upon the Case &a and that thereof he Should not fail &a
   
              And the aforesaid William Camplin by Robert Jenckins Henry by his attorney Complains
against the said William Kitchen in the plea afd as followeth viz.t

    Somerset County ss.t   William Kitchen Late of Somerset County Marriner was attached to
