(72) County of a plea that he render unto him the sum of one thousand three hundred and twenty pounds of good Sound Tobacco which unto him he oweth and unjustly detaineth &.a And whereupon the same Joseph by William Goldsborough his attorney saith that whereas the af.d William the twenty Seventh day of March in the year of our Lord God Seventeen hundred and thirty five at Somerset County af.d by his certain writing obligatory had granted himself to be bound unto the af.d Joseph in the af.d Sum of One thousand three hundred and twenty pounds of good sound Tobacco to be paid unto the said Joseph when thereof afterward he should be required Nevertheless the af.d William altho' often required the af.d One thousand three hundred and twenty pounds of Tobacco unto the af.d Joseph hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same Joseph two thousand Six hundred pounds of Tobacco and therefore he brings Suit &.a and doth bring hereinto Court the writing obligatory af.d which the debt af.d in form af.d testifies the date whereof is the same day and year af.d &.a Pledges &.a John Doe & Rich.d Roe Whereupon the said William Robinson by Robert Jenckins Henry his attorney cometh and defendeth the force and Injury when af.d and saith that he cannot gainsay the action af.d of the af.d Joseph Macclester nor can he say but the writing obligatory af.d is the deed of him the same William Robinson nor can he say but that he owes the af.d Joseph M.cClester the af.d one thousand three hundred and twenty pounds of Tobacco in manner and form as the af.d Joseph M.cClester above against him hath declared wherefore the same Joseph prays Judgment for his debt af.d and his damages sustained by occasion of the detaining of the same debt to him to be adjudged &a Therefore it is Considered by the Court here that the af.d Joseph M.cClester recover against the aforesaid William Robinson his debt aforesaid and his damages sustained by Occasion of 156 the detaining of the same debt to Two hundred pounds pounds of tobacco to the same Joseph of his assent by the Court here adjudged and the af.d William in mercy &.a
