Nine pounds of tobacco residue of the said one hundred and sixty two thousand Seven
hundred and twenty Six pounds of tobacco the said Thomas his promise & assumption af.d
in manner & form af.d made nothing regarding but minding & fraudulently intending the
said Joshua in that part craftily and Subtilly to deceive & defraud the af.d Sixteen hundred
& sixty Nine pounds of tobacco Residue of the said one hundred and Sixty two thousand seven
hundred & twenty Six pounds of tobacco to the said Joshua hath not paid or him for the
same in any sort contented but the same to him to pay hath altogether refused & the
same to him to pay still doth refuse altho' the same to him to pay afterwards to wit the
the day & year af.d at the County af.d and often since that time the said Thomas by the said
Joshua was required whereupon the said Joshua says he is damnify'd four thousand pounds
of tobacco & thereof he brings Suit                                   Pledges &.a John Doe & R: Roe
