    damages by occasion of the premisses beyound his Costs and Charges by him about his Suit at that part
apposed to Four pounds nine Shillings and four pence three farthings and one hundred and Sixty Seven
pounds of tobacco and not more to be Levied of the goods and Chattells of the afd Benj.a to be administred
on &.a and because the afd John Denys not this but the Same allegation Confesseth to be true prays Judgmt
for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a

          Therefore it is Considered by the Court here that the aforesaid John Atkinson Recover against the afd
Joseph Houston Executor of the Same Benjamin Houston his damages aforesaid to the afd Sum of four pounds
nine Shillings and four pence three farthings Currt money and One hundred and Sixty Seven pounds of tob.o
323   in form afd Confessed as also three hundred & twenty three                                          pounds of tobacco
for his Costs and Charges aforesaid to the Same John by the Court here and Consent of the parties afd adjudged
to be Levied of the goods and Chattells which were of the afd Benjamin at the time of his death remaining ^in the hands of the afd Joseph Houston to be administred^
if so much thereof in his hands he hath and if so much in his hands he hath not taken the Costs and Charges
afd to be Levied of the proper goods and Chattells of the said Joseph Houston & the afd Deft in mercy &a

memorand.m the following account should have been Entered at the foot of the declaration but was omitted & Entered as
Followeth vizt                              Benjamin Houston                                                                        D.r

To ballance of account setled the 9.th day of march 1732/3 by agreement to be paid in Cash or pork
@ 10s p hundred                                                                                                                                 £4..9..4¾
                               and in tobacco                                 127 pounds
June ye 25.th 1733  To 1 Gallon of rum                            40 pounds of tobacco

The above account duely proven by John Atkinson before me one of his Lordships Justices of the peace
this 18.th day of Aprill 1733/4

to answer to Cornelius Kollock of a plea of trespass upon the Case &.a
And Whereupon the said Cornelius by Geo: Douglas his attorney complains
                                  that whereas the af.d Cornelius & Thomas on the first day of August Anno Domi
Seventeen hundred & twenty Nine at Somerset County af.d within the Juris of this Court
did account together of & Concerning certain Sums of Money by the said Thomas to the
said Cornelius before that time due & then in arrear & unpaid & upon that account the said
Thomas found in arrear towards the said Cornelius in the Sum of five pounds five
shillings & Eleven pence Current money of Maryland and being and being so thereof
