Robert hath not as Yet paid or to him for the same in any sort Contented altho' the
same to do the said Andrew afterwards (to witt) the same day and year and at the place
last abovesaid and often afterwards by the same Robert he was thereunto requested but
the Same to him hitherto to pay or Content the same Andrew hath altogether refused and
Still doth refuse and deny to the damage of the said Robert Six pounds Current money
aforesaid and four hundred pounds of Tobbacco and thereof he bringeth Suit &.ca

Whereupon the said Andrew Scott present herein Court in his proper person is by
the same Court Adjudged to give Special Bail to the action af.d thereupon a Certain
Joseph Macclester late of Somerset County Gentleman Came hereinto Court in his proper
person and undertook for the said Andrew Scott and assumed upon himself (Likewise
the said Andrew Scott assumed upon himself) that if in Case the said Robert Givan
should recover Judgment in the plea aforesaid against the said Andrew Scott or that
the said Andrew Scott should be therein Convicted that than he the said Andrew Scott
should pay the Condemnation of the Court thereupon or render his body in Execution of
Such Judgement to the prison of the sheriff of Somerset County in Satisfaction thereof
or that he the said Joseph Macclester will do the same for him &a

Whereupon the aforesaid Andrew Scott by William Beckingham his attorney Cometh
and defendeth the force and Injury when &a and Saith that he Cannot Gainsay the
action af.d of the af.d Robert Givan nor can he say but that he did assume upon
himselfe in manner & form as the af.d Robert Givan above against him hath Complained
and as to the damage of the Same Robert by him by Occasion of the premisses
in that part Sustained the Same Andrew saith and Confesseth that the af.d Robert
Givan hath Sustained damages by Occasion of the premisses beyond his Costs and Charges
by him about his Suit in that part apposed to Two pounds twelve shillings
and two pence Current money of Maryland & one hundred and Ninty Eight pounds of
