(33) fifty six pounds of Tobacco and thereof he brings Suit &cra
not received directly or Indirectly to the best of his knowledge any part or parcell of the within account of tobacco Charged therein or any sec.ry or satisfaction for the same more then Credit given June 20.th 1735 Jurat Coram me Th.s Williams A Copy of the foregoing declaration and account were made and Sent to be Served on the defend.t with the writt in the plea aforesaid Att which said third tuesday of June to witt the Seventeenth day of the same month anno Dom One thousand Seven hundred and thirty five being the day of the return of the writt afd Came the aforesaid Joshua Caldwell by his attorney aforesaid and the Sheriff of Somerset County to witt Joseph MccClester Gent at the same day made return that the aforesaid John Horsey is not found &a Whereupon the said Joshua Caldwell by his attorney afd prays that forasmuch as he hath Complyed with the Law in order to an attachment he may have Judgment against the said John Horsey Executor of the afd William Horsey for his damages afd by way of attachment according to act of assembly &a whereupon for that it seems to the Court here that the said Joshua Caldwell has Complyed with the Law as alledged Therefore it is Considered by the Court here that the aforesaid Joshua Caldwell recover against |
