before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next to satisfie Francis Porter of three pounds ten Shillings Curr.t money of Maryland and Two hundred and thirty four pounds of tobacco which to the same Francis Porter in the same Court before the Justices thereof at dividing Creek afd were adjudged for his damages which he had by Occasion of a Certain promise and assumption to the Same Francis by the afd John Made and not performed whereof he is Convict &c Att which said third Tuesday of November to witt the Sixteenth day of the same month anno Dom One thousand seven hundred and thirty Six being the day of the return of the said Writt Came the said Francis Porter by William Beckingham his attorney and the Sheriffe of Somerset County to ^witt Jos: McClester Gent to^ who the foregoing writt was directed Likewise Cometh and returned that by Vertue of the writt afd to him thereof directed he had taken the body of the said John Bell whose body before the Justices of his Lordships County Court of Somerset at the Same day and place in the writt afd mentioned he had there ready &c And whereupon the said John Bell being by the Sheriff afd Ledd to the Barr by virtue of the Writt afd and being Asked by the Court here ^whether he^ was the very Same John Bell the Same person which the afd Francis Porter the damages afd before is Convict^d^ or not who says that he is Therefore the Same John is Committed into the Custody of the Sheriffe of the County afd there to remain in safe Custody untill the afd Francis of the damages afd is satisfied and Contented the said Sheriff to witt Joseph MccClester Gent present by Littleton Townsend his deputy took Charge of the Said Jno accordingly &c
before the Justices of his Lordships County Court of Somerset to be held at Dividing Creek in the same County the third Tuesday of November then next to answer unto Francis Allen of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said Third Tuesday of November to witt the Sixteenth day of the Same month anno |
