274 pounds of tobacco for his Costs and Charges aforesd to the Same Samuel Dickerson at his request by the Court here by Consent of the parties afd adjudged &c and the afd defend.t in mercy &c
detaineth &c And Whereupon the same Thomas by William Goldsborough his attorney saith that whereas the afd Abraham the tenth day of May in the year of ^our^ Lord God seventeen hundred thirty and six in Somerset County afd by his certain bill obligatory which the same Thomas with the seal of the said Abraham sealed hereinto Court doth bring the date whereof is the same day and year had acknowledged himself to owe unto the afd Thomas the afd sum of five pounds two shillings and six pence Current money to be paid unto the afd Thomas when thereunto afterwards he should be required to which payment well and truly to be made the afd Abraham did bind himself firmly by the same bill Nevertheless the afd Abraham altho often required the afd sum of money unto the same Thomas yet hath not paid but that unto him hitherto ^to^ pay altogether hath refused and still doth refuse to the damage of the same Thomas tenn pounds like money and thereupon he bringeth suit &c Pledges &a Jno Doe & R Roe And the afd Abraham Johnson by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the afd Tho.s Watkins nor Can he say but that the writing Obligatory afd is the deed of him the Same Abraham nor but that ^he oweth^ the Same Thomas the afd five pounds two shillings and Six pence Currant money in manner and form as the afd Thomas first above against him declared thereupon the said Thomas prays Judgm.t for his debt afd and his damages Sustained by occasion of the detaining of the Same debt to him to be adjudged &a Therefore it is Considered that the afd Thomas Watkins Recover against the afd Abraham Johnson his debt aforesaid and his damages by occasion of the detaining of the same debt to Two hundred and thirty one pounds of tobacco to the same Tho.s 187 of his assent by the Court here adjudged and the afd Abraham in Mercy &a
