260 Kitchen present herein Court in his proper person ^assumed upon himselfe^ that if in Case the said William Camplin should recover Judgment in the plea afd against the said William Kitchen or that the said William Kitchen should be therein Convicted that then he the said William Kitchen should pay the Judgment of the Court thereon or Render his body in Execution of Such Judgment to the prison of the Sheriffe of Somerset County in satisfaction thereof or that he the said Peter Taylor will do the Same for him &a And the same William Kitchen by Francis Allen his attorney Cometh & defendeth the force and Injury when &a and prays Leave ^thereof^ to Imparle hereuntill next Court and he hath it and the Same day is given to the afd William Camplin here also &a Att which said next Court to witt the seventeenth day of August of Anno Dom One thousand seven hundred and thirty Six Came againe as well the afd William Camplin as the afd William Kitchen by their attorneys afd and whereupon the same William Camplin prays that the afd William Kitchen to his declaration afd may answer and the same W.m Kitchen altho' at the same day Solemnly Called Cometh not nor says nothing in Barr or preclusion of the action afd of the afd William Camplin by which the Same William Camplin remains against the Same William Kitchen thereof undefended &a For that the same William Camplin his damages afd against the afd William Kitchen by Occasion of the non performance of the promise and assumption afd ought to recover but because it is not known to his Lordships County Court of Somerset here what damages the afd William Camplin by occasion afd in that sustained therefore it is Commanded the Sheriffe of Somerset County that by the Oath of honest and Lawfull ^men^ of his bailywick that he diligently Inquire what damages the afd William Camplin hath sustained by occasion of the nonperformance of the promise and assumption afd beyond his Costs and Charges by him about his Suit in that part Apposed and the Inquisition which thereupon he should take to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November ^then^ next under his Seal and the seals of those by whose Oath he makes the same Inquisition he send together with the writt thereof to him directed and the same day is given to the afd William Camplin there &a
