225 Anno Dom one thousand Seven hundred and thirty Five Came againe as well the afd Thomas Lambden as the afd Thomas Billings and Thomas Gardner by their attorneys afd and whereupon the said Thomas BIllings and Thomas Gardner pray further Leave thereof to Imparle hereuntill next Court and they have it and the Same day is given to the afd Thomas Lambden here also &a Att which said next Court to witt the Eighteenth day of November anno Dom one thousand Seven hundred and thirty five Came againe as well the afd Thomas Lambden as the afd Thomas Billings and Thomas Gardner by their attorneys afd and whereupon the said Thomas Billings and Thomas Gardner pray further Leave thereof to Imparle here untill next Court and they have it and the same day is given to the afd Thomas Lambden here also &a Att Which said next Court to witt the sixteenth day of March anno Dom One thousand Seven hundred and thirty five Came againe as well the afd Thomas Lambden as the afd Thomas Billings & Thomas Gardner by their attorneys afd and whereupon the said Thomas Billings and Thomas Gardner pray further Leave ^thereof^ to Imparle hereuntill next Court and they have it and the Same day is Given to the afd Thomas Lambden here also &a Att which said next Court to witt the fifteenth day of June anno Dom One thousand seven hundred and thirty Six Came againe as well the afd Thomas Lambden as the afd Thomas Billings and Thomas Gardner by their attorneys afd And whereupon the said Thomas Billings & Thomas Gardner by their attorney afd defend the force & Injury when &a and protesting that he the said Thomas Gardner is not Executor of the said William for plea they say that the said William Smith in his Life time did not assume upon himselfe in manner and form as the said Thomas Lambden above against them hath Complained and of this they putt themselves upon the Country And the afd Thomas Gardner and Thomas Billing by Leave of the Court here and according according to the form of the statute in that case lately made and provided protesting that he the said Thomas Gardner is not Executor of the testament and last will of the said William Smith protesting also that he the said William Smith in his life time did not assume upon himself in manner and form as the said Thomas Lambden above ag^a^inst them hath Complained for plea that Nevertheless the said Thomas Gardner and Thomas Billings severally say that the said Thomas Lambden his action afd against them the said Thomas Gardner and Thomas Billings ^to have & maintain ought not because they say that they the said Thomas Gardner & Thomas Billings^ have fully Administred all the goods and chattels which were of the afd William Smith at the time of his death and that they or either of them have no Goods or Chattels which were of the afd William Smith at the time of his death in their hands to be Administred nor had at the day of the impetration of ^the^ originall writt of him the said Thomas Lambden nor ever afterwards and this they are ready to verify wherefore they pray Judgment if the said Thomas (Lambden) |
