220 made and sent be Left at the Last place of the defend.t according to act of assembly in Such Case made and provided &a Att which said Third Tuesday of June to witt the fifteenth day of the Same month Anno Dom One thousand Seven hundred and thirty Six being the day of the Return of the said Writt Came the said Thomas Fletcher by Francis Allen his attorney and the sheriffe of Somerset County to whom the foregoing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorsed in these words Non Est Inventus short note Left P Joseph MaClester sher Whereupon the said Thomas Fletcher by his attorney afd prays that for as much as he has Complyed with the Law in order to an attachment he may have Judgment against the said Walter Codd for his damages afd by way of attachment according to act of assembly &a Whereupon for that it seems to the Court here that the said Thomas Fletcher has Comply with the Law as alledged Therefore it is Considered by the Justices here that the Said Thomas Fletcher recover against the said Walter Codd the Sum of two thousand and Eighty Eight and one quarter pounds of tobacco his damages by Occasion of the premisses afd as also all Costs and Charges by the said plft Laid out and Expended about 319 his suit by way of attachment against the goods Chattells Rights or Creditts of the said Walter Codd according to act of assembly in such Case made and provided &a
And whereupon the said Wrixham by Francis Allen his attorney saith that whereas the said John the ninth day of march One thousand Seven hundred and thirty One at the County of Somerset afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the said Wrixam with the seal of the said John Signed hereinto Court brings the date whereof is the same day and year did acknowledge himselfe to be bound unto the afd Wrixam in the afd Twenty pounds to be paid to the same Wrixam when he should be thereunto required yett the said John tho' often Required the said twenty pounds to the said Wrixam hath not rendered but the Same to him hitherto to render hath denyed and Still doth deny and unjustly detain to the damage of the said Wrixham of ten pounds Curr money of Maryland afd and thereupon he brings Suit &a pledges &a Jno Doe R Roe And the afd John Crapper in his own proper person Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Wrixam here also &a Att |
