181 or render his body to the prison of the Sheriff of Somerset County in Satisfaction of such Judgmt or that he the afd Dunkin Murray will do the same for him &a Whereupon the afd John Charles in his own proper persons cometh and defendeth the force and Injury when &.a and saith that he Cannot gainsay the action of the afd Dunkin John Fullerton nor Can he say but that he did assume upon himselfe in manner and form as the afd John Fullerton above against him hath Complained and as to the damage of the Same John Fullerton by him by occasion of the premisses in that part Sustained the same John Charles saith and Confesseth that the afd John Fuller hath Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to three pounds tenn shillings and tenn pence Curr.t money of america and not more and because the afd John Fullerton denys not this but the Same allegation Confesseth to be true prays Judgm.t for those damages above Confessed together with his Costs & Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered by the Court here that the afd John Fullerton recover against the said John Charles his damages afd to the afd three pounds tenn Shillings & tenn pence Curr.t money of america his damages afd in form afd Confessed as also 254 pounds of tobacco for his Costs and Charges afd to the same John Charles by the Court here and Consent of the parties afd adjudged and the afd deft in mercy &a
held at dividing Creek the third Tuesday of November then next to answer unto John Britt of a plea of trespass upon the Case &.a and that thereof he Should not fail &a Att which said third Tuesday of November to witt the eighteenth day of the same month Anno Dom One thousand Seven hundred and thirty five being the day of the Return of the said Writt Cometh the said John Britt by William Beckingham his attorney and the Sheriff of Somerset County to whom the Foregoing writt was directed Likewise Cometh & maketh return thereof to the court here Endorsed in these words Following viz.t Cepi Corpus p Joseph MaClester sher Whereupon the said John Pitts by George Douglas his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court & he hath it & the Same day is given to the afd John Britt here also &a Att which said next Court to witt the Sixteenth day of March anno Dom One thousand seven hundred and thirty five Came againe as well the afd John Britt as the afd John Pitts by their attorneys afd and forasmuch as the said John Britt did not declare against the afd John Pitts nor prosecute his writt in the plea afd with effict Therefore he and his pledges of Prosecuting bein in mercy and Lett the names |
