154 peace for the County of Somerset John Dennis Jun.r and made Oath on the holy Evangelist of almighty God that the within account is Just and True and that he hath not rec.d any part or parcell thereof more than what is given Cred.t for to the best of his knowledge Sworne to before me Isaac Handy Att which said Third Tuesday of March to witt the Sixteenth day of the Same month anno Dom One thousand Seven hundred and thirty five being the day of the return of the same writt Came the said John Dennis Jun.r by Francis Allen his attorney and the Sheriffe of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed vizt Non est Inventus short note Left P Joseph MccClester sheriffe Whereupon the said John Dennis Jun.r by his attorney afd prays that foras much as he has Complyed with the Law in order to an attachment he may have Judgm.t against the said John Donelson for his damages afd by way of attachment according to act of assembly &.a whereupon for that it Seems to the Court here that the said John Dennis has Complyed ^with the Law^ as alledged Therefore it is Considered by the Court here that the aforesaid John Dennis Jun.r Recover against the aforesaid John Donelson his damages afd to the afd five thousand three hundred and Eighty three 335 pounds of tobo and Nine pounds in gold as also all Costs and Charges by the said John Dennis Laid out and Expended by way of attachment against the goods Chattells Rights and Creditts of the said John Donelson according to act of assembly in such Case made and provided &a
Court of Somerset to be held at dividing Creek the third Tuesday of March next to answer unto Thomas Mitchell of a plea that he render unto him Eight hundred pound of good merchantable Pork in hoggs that at the Least shall way One hundred pound weight which to him he oweth and unjustly detaineth &a and that thereof he Should not fail &a And the said Thomas Mitchell by Francis Allen his attorney declared against the aforesaid John Bishop in the plea aforesaid as followeth vizt Somerset County ss.t John Bishop |
