further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the
afd samuel here also &a

          Att which said next Court to witt the twentieth day of November ^one thousand Seven hundred & thirty three^ Came againe as well the afd
Samuel Oldham as the afd Thomas Billing by their attorney afd and ^whereupon^ the Same Thomas Billing defends the
force and Injury when &a and Saith that he did not assume upon himselfe in manner and form as the afd
Samuel above against him hath Complained and of this he puts himselfe upon the Country &a

             Whereupon the afd Thomas prays that the afd Samuel may reply to his plea afd  But the Same Samuel
at the Same day altho' Solemnly Called Cometh not nor to the plea of the afd Thomas replyeth nor is his writt
and declaration afd against the Same Thomas further prosecuted &a

           Therefore it is Considered by the Court here that the afd Samuel Oldham take nothing by his writt and
declaration afd but that he and his pledges of prosecuting to witt John Doe and Richard Roe be in mercy
and that the afd Thomas Go thereof without day &a    And further it is Considered that the afd Thomas Billing
213   Recover against the afd Samuel Oldham Two hundred & thirteen                                      pounds of tobo
for his Costs and Charges by him about his defence in that part Sustained to the same Thomas by the Court here
according to the form of the Statute in Such manner of Case thereof made and provided adjudged and that the
same deft have thereof Execution &a

    Command was given to the sher of Somerset County that he should take W.m
Hopkins Late of Somerset County planter if he should be found in his bailywick
                               and him should safe keep so that he might have his body before the Justices
of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of Aug.t
then next to answer unto Peter Chaille of a plea of trespass upon the Case &a and that thereof he
should not fail &a    Att which said third tuesday of August to witt the fifteenth day of August the ^same month^ Anno Dom
One thousand Seven hundred and thirty two being the day of the return of the said Writt Cometh the said Peter
Chaille by William Beckingham his attorney and the sher of Somerset County to whom the foregoing writt was directed
Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t
                                                                                              Cepi Corpus p Jos.a Caldwell sher

       And the said William Hopkins by George Douglas his attorney Cometh and defendeth the force
and Injury when &a and prays Leave thereof to Imparle here untill the next Court and he hath it and the
Same day is Given to the afd Peter Chaille here also &a

       Att Which said next Court to witt the twenty first day of November Anno Dom One thousand Seven
hundred and thrity two Came againe as well the afd Peter Chaille as the afd William Hopkins by their
attorneys afd And Whereupon the Same William prays further Leave thereof to Imparle hereuntill
next Court and he hath it and the Same day is given to the afd Peter here also &a
