(271) And the aforesaid Henry Toadvine by George Douglas his attorney Comes and defends the force and Injury when &.c And prayeth leave thereof to Imparle here untill next Court and he hath it and y.e same day is given to the af.d Isaac Here also &.c Att which said next Court to witt the eighteenth day of March anno Dom One thousand Seven hundred and thirty four Came againe the aforesaid Isaac Handy as the afd Henry Toadvine by their attorneys aforesaid and whereupon the said Henry as before defends the force and Injury when &.a and says that he is no sort Guilty of the premisses above upon him Imposed in manner and form as the said Isaac above against him hath Complained and of this he puts himselfe on the Country and the afd Isaac in like manner Thereupon it is Commanded the sheriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now Sitting at dividing Creek in the County aforesaid Twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterwards Immediately came thereof the Jury &.a and the Jurors of that same Jury by Joseph McClester Gent Sheriff of the County afd to this Impannelled being Called came to witt James Rownd Thomas Holbrook John Dennis Jun.r James Jones Manny Robert Mitchell Thomas Lambden, James Strawbridge Geo: Benston, William Mills Lewis Jones Charles Townsend & Isaac Marshall who to say the truth of the premisses aforesaid being duely Elected tryed and sworn upon their oath did say that the aforesaid Henry Toadvine is guilty of the premisses in manner and form as the afd Isaac Handy above against him hath Complained and assessed the damages of the Same Isaac by occasion of the premisses beyound his Costs and Charges by him about his suit in that part apposed to Fifty Shillings Currant money &a Therefore it is Considered that the afd Isaac Handy recover against the afd Henry Toadvine his damages afd by the Jurors afd in form afd assessed as also Eleven hundred & fifty 1150 pounds of tobacco for his Costs and Charges afd to the Same Isaac by the Court here of his assent adjudged which Certain damages in the whole do amount to fifty shillings currant money and pounds of tobacco and the afd defend.t in mercy &a
