234 the same Nehemiah and Barbara by them by Occasion of the premisses in that part Sustained the same William Holstein saith and Confesseth that the afd Nehemiah and Barbara have Sustained damages by occasion of the premisses beyound their Costs and Charges by them about their Suit in that part apposed to Seven hundred and thirty pounds of tobacco ^and not more^ and because the afd Nehemiah and Barbara denys not this but the Same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges aforesaid to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Nehemiah Watt and Barbara his wife Executrix of the afd Daniel Welbourn Recover against the afd William Holstein their damages afd to the afd seven hundred and thirty pounds of tobacco in form aforesaid 215 Confessed as also Two hundred & fifteen for their Costs and Charges afd William the same Nehemiah Watt and Barbara his wife by the Court here and Consent of the parties afd adjudged and the afd William Mercy &a
so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next to answer unto William Turpin the Younger of a plea that he render unto him the Quantity of three thousand and Eighteen pounds of good and Merchantable Tobacco at a Convenient Landing which from he unjustly detaineth &a And the af.d William Turpin the Younger by William Beckingham his attorney declared against the af.d Capewell King in the plea af.d as followeth Vizt Somerset County ss Capewell King late of Somerset County Gentleman Executor of the testament and last will of Benjamin King late of Somerset County planter deced otherwise lately called Benjamin King was Sumoned to answer unto William Turpin the Younger of a plea that he render unto him the Quantity of three thousand and Eighteen pounds of good and Merchantable Tobacco at a Convenient landing which from he unjustly detaineth &.a And Whereupon the same William Turpin by William Beckingham his attorney saith that whereas the said Benjamin in his life time to witt on the first day of October in the year of our Lord Seventeen hundred & thirty one at Somerset County by his Certain bill obligatory which the same Wm Turpin with the seal of the same Benjamin sealed hereinto Court brings whose date is the same day and year acknowledged himself to owe unto the same Wm Turpin three thousand and Eighteen pounds of good & Merchantable tobacco at a Convenient landing (to |
