(233) Somerset County that by the Oath of honest and Lawfull men of his bailywick he diligently Inquire what damages the same Comfort has sustained as well by Occasion of the non performance of the promise and assumption af.d as for her Costs and Charges by her about her suit in that part apposed and the Inquisition which thereupon he should take to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August next under his seal and the seals of those by whose Oath he Should make that same Inquisition he send together with the writt thereof to him directed &.a and the same day is given to the same Comfort there &a Att which said third tuesday of June to witt the Eighteenth day of the Same Month ann.o Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset at dividing Creek Cometh the afd Comfort Jenckinson by her attorney aforesaid and the sheriffe sends not thereof the writt &.a Therefore before it is Commanded the sheriffe of somerset County that by the Oath of honest and Lawfull men of his bailywick he should diligently Enquire in form afd &a and the Inquisition which &.a to his said Lordships County Court of somerset to be held at dividing Creek the third tuesday of Novemr then next under his Seal & the seals &a he send together with the writt thereof to him directed &a and the same day is Given to the afd Comfort there also &a Att which said third tuesday of November to witt the Nineteenth day of the same month anno Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset then held at dividing Creek in the same County Cometh the said Comfort Jenckinson by her attorney afd and the Sheriffe to witt Joseph McClester Gentleman returned a Certain Inquisition Indented and taken before him at the Court house at dividing Creek in the County afd the Eighteenth day of November anno Dom One thousand seven hundred and thirty four by the oath of Honest and Lawfull men of his bailywick by which it appears that the said Comfort Jenckinson hath Sustained damages by Occasion of the Non performance of the promise and assumption afd beyound her Costs and Charges by her about her Suit in that part apposed to thirteen pounds ten shillings and Seven ^pence^ Currant money of maryland & for those Costs & Charges to one pound of tobo Therefore it is Considered that the afd Comfort Jenckinson recover against the afd Heber 1194 her damages afd as by the Inquisition afd appears also Twelve hundred and Seventeen pounds of tobacco for her Costs and Charges afd to the Same Comfort by the Court here of her assent of Increase adjudged which Certain damages in the whole do amount to thirteen pounds ten shillings and seven pence Curr.t mony of Maryland and Twelve hundred and Eighteen pounds of tobacco and the afd Heber in Mercy &a |
