(227) Rober.t Bolton recover against the af.d John Bowin his damages af.d to the af.d four pound Eight Shillings & Eight pence ^Currt money^ in form af.d Confesseth as also 263 Two hundred & sixty three pounds of Tobacco for his Costs and Charges af.d to the same Robert Bolton by the Court here and Consent of the parties af.d adjudged and the af.d John in mercy &.a
his life time to wit the fifteenth day of April which was in the year of our Lord God seventeen hundred thirty and one at Somerset County af.d within the Jurisdiction of this Court (the same Philemon Loyd then and there Negotiating and Comerce using) his certain bill in writing according to the use and Custom of Merchants from time whereof the memory of man is not to the Contrary used and approved did make and with his proper hand subscribe bearing date the same day and Year and and that bill unto the af.d John Purnell by the name of M.r John Purnell high Sher of Somerset County then at the County af.d and within the Jurisdiction af.d negotiating and Commerce using did direct and by the same bill did require the af.d John Purnell to pay unto a certain John Lawson lately deceased in his life time then at the County af.d and within the same Juridiction negotiating and Commerce using or to his order the sum of four thousand pounds of tobacco for Value received and to place the same to the Account of him the said Philemon Loyd which same bill so as af.d made subscribed and directed the same John Lawson in his life time after the making thereof to wit the twentieth day of april in the year af.d at the County af.d within the the Jurisdiction af.d unto the af.d John Purnell did shew and the same John Purnell that bill according to the use and Custom of Merchants from all the time af.d used and approved to accept then and there did require and to make payment of the said four thousand pounds of Tobacco according to the form and Effect of the same bill and the same John Purnell that bill then and there according to the use and Custom of Merchants did accept and the af.d John Lawson in his life time afterward and before payment or satisfaction of the said Tobacco in the said bill mentioned (to wit) the first day of May in the year af.d within the County and Jurisdiction af.d by an Indorsment upon that bill made and with his proper hand subscribed according to the use and Custom of Merchants did assign the bill af.d and the Tobacco therein mentioned unto a certain William Kennerly (the same William Kennerly then and there Negotiating and Commerce using) for value from him received and did require the af.d John Purnell to pay unto the af.d William Kennerly or his order the same sum of Tobacco (whereof) |
