himself in manner and form as the af.d Zachariah Maccubbin above against
him hath complained and as to the damage of the same Zachariah by him
by Occasion of the premisses in that part Sustained the same John saith
and Confesseth that the af.d Zachariah hath sustained damages by Occasion
of the premisses further than his Costs and Charges by him about his suit in
that part apposed to Twenty seven pounds shillings and not more and because
the af.d Zachariah deny's not this but the same allegation Confesseth to be
true prays Judgment for those damages above confessed together with his Costs
and Charges af.d to him to be adjudged &a

    Therefore by Consent of the parties af.d it is Considered that the aforesaid
Zachariah Maccubbin recover against the af.d John Evans his damages
af.d to the af.d Twenty seven pounds shillings in form af.d Confessth as also
417   four hundred & seventeen          pounds of tobacco for his Costs and
Charges af.d to the same Zachariah by the Court here and Consent of the parties
af.d adjudged and the aforesaid John in mercy &.a  with stay of Execution untill
the tenth day of February Next &a

    Command was given to the Sher of Somerset County
that he should take John Bowin Late of Somerset
County planter if he should be found in his bailywick
and him ^should^ safe keep so that he might have his body before
the Justices of his Lordships County Court of Somerset to be held at dividing Creek
the third tuesday of November then next to answer unto M.r Robert Bolton
of a plea of trespass upon the Case &.a and that thereof he should not fail &.a

And the af.d Robert Bolton by Francis Allen his attorney Complains against
the af.d John Bowin in the plea af.d as followeth Viz.t

Somerset County ss  John Bowin late of Somerset County planter was attached
to answer unto M.r Robert Bolton of a plea of trespass upon the Case &.a

And whereupon ye s.d Robert by Francis Allen his attorney Complains that
whereas after the first day of May Ann Dom seventeen hundred & five to
witt on the seventeenth day of February Ann Dom seventeen hundred & thirty
two the aforesaid John at Somerset County aforesaid within the Jur of this
Court made his Certain note in writing called a promissory note with his proper
hand subscribed bearing date the day & year last mentioned and the s.d note
to the s.d Robert then & there delivered by which sd Note the s.d John did promisse
