(135) the sume is Determined by your Worships in Equity and also his Lordships Writt of subpena to the said James to be Directed thereby Commanding him at a Certain Day and Under a Certain pain therein to be Limited personally to be and appear before your Worships in a Court of Chancery and to Answer the premises and to stand to such Decree therein as to your Worships shall seem agreeable to Equity and Good Conscience and Your Orator shall pray Ja.s Dickerson Whereupon all and Singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had Wherefore it is Considered that the Petition afd be dismist and that the said James Dickerson take nothing thereby Likewise it is Considered that the afd James Breman Recover against the afd James Dickerson his damages afd to the afd three pounds One shilling and 578 six pence Curr.t money as also Five hundred & Seventy Eight pounds of tobacco for his Costs and Charges to the Same James Breman by the Court here adjudged and the afd James Dickerson in Mercy &a
Indebted unto the Said John in seven thousand two hundred and fifty six pounds of Tobacco it being as well for sundry sums of Tobacco by the said John for the said William at the Special Instance and Request of the said William before that time Deposited and paid as for sundry sums of Tobacco by the said William to and for the Use of the said John before that Time from sundry persons had and Received as by a particular account thereof hereunto annexed and here in Cort produced may appear and being So thereof Indebted the said William in Consideration thereof the Day and Year aforesaid at the county aforesaid within the Jur aforesaid upon himself Did assume and to the said John then and there Did faithfully promisse that he the said William the said seven thousand two hundred and fifty six pounds of Tobacco to the Said John when he should be afterwards thereunto Requested he would well and faithfully pay and Content and altho' the said William one hundred and fourteen pounds of Tobacco percell of the aforesaid seven thousand Two hundred and fifty six pounds of Tobacco to the said John he hath paid and satisfied yett as to seven thousand one hundred and Forty Two pounds of Tobacco residue of the aforesaid seven thousand Two hundred and Fifty Six pounds of Tobacco the said William his promise and assumption aforesaid in forme aforesaid made Nothing Regarding but plotting and fraudulently Intending the said John in that part Craftilly and Subtilly to Deceive and Defraud the said seven thousand one hundred and forty Two pounds of Tobacco to the said John hath not paid or Contented altho' the same to Do the said William by the said John on the aforesaid first Day of March in the Year aforesaid and Often Afterwards at Somerset ^the^ County aforesaid he was (thereunto |
