(134) Attorney Complains that whereas the said James Dickerson after the first Day of May Anno Dom Seventeen hundred and five to Witt on the Twentieth Day of July Ann Dom seventeen hundred and thirty two at Somerset County aforesaid within the Jurisdiction of this Court made his Certain Note in Writing Called a promissory Note with his proper hand thereunto Subscribed bearing Date the same day and Year Last Mentioned abovesaid and the same Note to the said James Breeman then and there Did Deliver by which said note the said James Dickerson Did promisse to pay to the said James Breeman or Order the Sum of three pounds one shilling & Six pence in Pork at Tenn Shillings p Ct by the Tenth Day of December Next Ensuing for Value Received And by reason thereof as also by force of the Statute in that Case Lately made and provided the Said James Dickerson became Chargeable to pay to the said James Breeman the aforesaid sum of Money According to the Tenor of the said Note and so being Chargeable the aforesaid James Dickerson afterwards to Witt on the aforesaid Twentieth Day of July Ann Dom seventeen hundred and thirty Two at Somerset County aforesaid Within the Jur afd in Consideration thereof upon himself Did Assume and to the said James Breeman then and there Did faithfully promisse to pay the aforesaid sum of Money According to the tenor of the Same Note Nevertheless the said James Dickerson his promisse and assumption aforesd in form aforesd made Nothing regarding but plotting and fraudulently Intending the said James Breeman in that part Craftilly and Subtilly to Deceive and Defraud the said three pounds tenn Shillings and Six pence in pork at Tenn Shillings p Ct to the afd James Breeman According to the Tenor of the said Note hath not paid or Contented altho' the same to Do the said James Dickerson afterwards to Witt on the Tenth Day of December the Year aforesaid Last Mentioned & often afterwards at Somerset County aforesaid he was thereunto requested but the same to him hitherto to pay or Content hath Refused and Still Doth Refuse and Deny to the Damage of the said James Breeman of Six pounds Three shillings Currant Money of Maryland and thereupon he brings suite &a pledges &a Jno Doe & Ri Roe And the afd James Dickerson by George Douglas his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd James Breman here also &a Att which said next Court to witt the Twentieth day of November Anno Dom One thousand Seven hundred and thirty three Came again as well the afd James Breman as the afd James Dickerson by their attorneys afd and whereupon the said James Dickerson prays further Leave thereof to Imparle here untill |
