9 M.r William Polk aged fifty ^Eight^ years or there abouts being sworn on the holy Evangelist of almighty God deposeth and saith that at the time that Francis Roberts was Married to his sister that the deponant with the said Roberts and severall Others was coming from his fathers to a fort hous which stood on a tract of Land Called Elliotts Choice belonging to the said Roberts and this deponant further Saith that the afd Roberts pointing to a larg Pine which stood by the marsh side about One hundred and fifty yards from the said fort house and said that that Pine was the first bounder of Elliotts Choice and further Saith not his William W Polke marke Mr Charles Williams aged Eighty Years or there abouts being Sworn on the holy Evangelist of almighty God deposeth and Saith that he has been in Company with Francis Roberts Severall times and that the said Roberts has pointed towards a large pine which Stood by the marsh side near the place where the deponant now sitts which is about two hundred and fifty yards from the dwelling house of Edward Roberts and about South from the Said house and told him that that pine was the first bounder of Elliotts Choice and further Saith not his Charles C Williams marke Margrett Williams aged sixty Years or thereabouts being sworn on the holy Evangelist of almighty God deposeth and saith that about Nine Years agoe the Land Commissions was on a tract of Land Called Elliotts Choice and that she the deponant was present and John Roberts said that the pine Stump which the deponant ^now^ Stands by was not the bounder of Elliotts Choice but that it was further down but Richard Wallis Sen.r said this is the bounder likewise said John White and my husband Charles White Williams and further Saith not her Margrett |—|—| Williams marke Owen Day aged about forty years being Sworn on the holy Evangelist of almighty God deposeth and sayeth that James Polk told him that he helpt to fall a tree standing near a marsh about two hundred and fifty yards from the dwelling house of Edward Roberts and about south from the said house and the deponant further saith that he heard James Polk tell William Whittington that the Stump of the tree which he fell was the bounder of Elliotts Choice and that W.m Whittington Run from the said Stump and further Sayeth not his Owen O Day marke Joseph Polk aged forty one Years or there about being Sworn on the holy Evangelist of almighty God deposeth and Saith that about Twenty five Years agoe he was in a peach orchard in Company with One John Hillman and that he the said Hillman told the deponant he would show him the bounder of Elliotts Choice as Samuel Jones told him and they went to a pine Stump standing near marsh side about two hundred and fifty yards from the dwelling house of Edward Roberts and about south from the Said hous the deponant further Saith that the Said Hillman told him that a Corder post standing by the Said Stump was putt up by Samuel Jones ^as^ the said Jones told the Said Hillman and that it was the first bounder of Elliotts Choice and that Samuel Jones took Severall Young people and told them that the afd bounder was the first bounder of Elliotts Choice the deponant Sayth that John Roberts Interupted James Polk on his Oath and that Richard Wallis Senr standing by said that John Roberts was a liar for the afd Pine stump was the first bounder of Elliotts Choice Likewise John White Sen.r said John Roberts was a rogue for the pine Stump aforesaid was the first bounder of Elliotts Choice and further Saith not Joseph Polk Priscilla Quatermus aged about thirty six Years being sworn on the Holy Evangelist of almighty God deposeth and saith that Samll Jones Came to his mother Ann Roberts and said I am come to settle the bounder of Elliotts Choice and that the said Jones went to a pine Stump where the deponant now Sitts near the side of a marsh about two hundred and fifty yards from the ^dwelling^ house of Edward Roberts and about South from the said house with the deponant and Severall Others and there set up a post at the root of the said Stump and that Samuel Jones told them that the Stump afd was the first bounder of Elliotts Choice and the deponant further Saith that John White Sen.r Laid his hand on the Stump aforesaid and said it was the first bounder of Elliotts Choice and Richard Wallis sen.r said Father White so it is in the presence of ye deponant she being than at the afd Stump and further Sayth not |
