8 the said Aaron [illegible] shillings and four pence halfe penny or tender unto the said [illegible] four pounds three shillings and one penny as he above hath alledged and this he prays may be Enquired of by the Country and the aforesaid defendent Likewise Whereupon the afd Isajah Quatermus by his attorney aforesaid Relinquisheth his verification aforesaid by him above pretended says that he Cannot gainsay the action aforesaid of the aforesaid Aaron nor Can he Say but that the writing Obligatory afd is the deed of the Same Isajah nor but that he owes the same Aaron the afd Ninteen pounds Eleven shillings and a penny Curancy of Maryland in manner and form as the afd Aaron above against him hath Complained declared wherefore the same Aaron prays Judgmt for his debt aforesaid and his damages Sustained by Occasion of the detaining of the Same debt to him to be adjudged &.c Therefore it is Considered that the afd Aaron Lynn Recover against the aforesaid Isajah Quatermus his debt afd and his damages by Occasion of the detaining of that same debt to four hundred & twenty 420 pounds of tobacco to the same Aaron by the Court here of his assent adjudged with stay of Execution for Six weekes and the afd deft in Mercy &c
Whereupon the said Henry Williams being Called appears and thereupon the said Henry Williams at the prayer of the aforesaid John Horsey by his attorney is adjudged to give Speciall bail to the action aforesaid Thereupon a Certain Michael Holland Jun.r present here in Court undertakes for the said Henry Williams that if in case the said John Horsey shall recover Judgment in the plea aforesaid against the said Henry Williams or that the said Henry Williams Shall be therein Convict that then he the said Henry Williams shall pay the Condemnation of the Court or Render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said Michael Holland will doe it for him &c
The Condition of the above Obligation is such that Whereas the Commisary Generall hath transmitted into this Court the amount of the estate of Wrixham Townsend dec.d wherein it is found that there is ballance due to the abovesaid orphan the sum of five pounds twelve shillings and two pence Currant money if therefore the said Thomas Claywell and Hutton Hill or any of them or either of their heirs Executors or administrators shall well and truely pay or Cause to be paid unto the aforesaid orphan the afd Sum of five pounds twelve shillings and two pence Currant money to be paid her according to act of assembly in such Case made and provided when she shall attain to full age to receive the Same then the above Obligation to be void Else to remain in full force and vertue Thomas Claywell (seal) Sealed and delivered in psence of Hutton Hill (seal) James Dashiell Thomas Hayward
