67 writt in the plea aforesaid Att which Said third tuesday of March to witt the sixteenth day of the Same month anno Dom One thousand Seven hundred and thirty being the day of the Return of the Said Writt Cometh the Said Francis Allen by this attorney aforesaid and the Sherr of Somerset County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed viz.t non est Inventus declaration Left P John Purnall sher Whereupon the afd Frances Allen by his attorney aforesaid prays that for as much as he hath Complyed with the Law in order to an attachment the day have Judgment against the Said Walter Jacobs by way of attachment for his Damages aforesaid According to Act of Assembly &.c whereupon for that it seems to the Court here that the Said Francis Allen has Complyed with the Law as alledged Therefore it is Considered by the Court here that the aforesd Francis Allen recover against the Said Walter Jacobs four hundred and sixty one pounds of Tobacco for his Damages by Occasion of the premisses aforesaid as all Costs and Charges by the said plef.t Laid out and Expended about his Suit by way of Attachment against the Goods Chattles Rights or Creditts of the said Walter Jacobs According to Act of Assembly in Such Case made and provided &.c
Attorney saith that whereof the aforesd Owin the twenty sixth day of febry ann Dom seventeen hundred and twenty seven at Somerset County with^in^ the Jur of this Court by his Certain Writing Obligatory Granted himself to be held and firmly bound unto the Same James In the aforesd sum of sixteen pounds and four pence Currancy the said Owin tho' often there to required the aforesd sum of sixteen pounds and four pence Currancy to the same James hath Not rendred but the said Owin the same hetherto To render hath altogether Denyed and Still Doth Deny and ^Unjustly^ Detain &.c And the Sames James brings here Into court the Writing Obligatory aforesaid &c L Gale P Quer Pledges &.c Jno Doe Rochd Roe And the Said Owen Cashiday by Francis Allen his attorney Comes and defends the force and Injury when &c and thereof to Imparle here untill the Next Court and he had and the Same day is Given to the afd plft there also Att which Said next Court to witt the Sixteenth day of June anno Dom One thousand Seven hundred and thirty Came again as well the aforesaid James Rownd as the aforesaid Owen Cashiday by their attorney aforesaid and whereupon the Same Owen prays further Leave to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid James here also &c Att which said next Court to witt the Eighteenth day of Aug.t Ann.o Dom One thousand seven hundred and thirty Came again as well the aforesaid James Rownd as the aforesaid Owen Cashiday by their Attorney aforesaid and whereupon the same Owen prays further Leave to Imparle here untill the Next Court and he had it and the same day is Given to the aforesaid James here also &.c Att which said Next Court to witt the seventeenth day of November Anno Dom one thousand seven hundred and thirty Came again as well the aforesaid James Rownd as as the aforesaid Owen Cashiday by their Attorney aforesaid and Whereupon the Same Owen prays further Leave to Imparle here untill the Next Court and he had it and the same day is Given to the aforesaid James here also &.c Att which said Next Court to witt the sixteenth day of March Anno Dom one thousand seven hundred and thirty Came again as well the aforesaid James Rownd as well (the) |
