assembly in such case made and provided and there cause to come before you or any
three or two of you all such Evidences as Shall be to you or any three or two of you nominated
by the said Complainant (or Def.t if any) and that you or any three or two of you Examine
them upon their Corporall Oaths to be by you or any three or two of you Administred on
the holy Evangelist of Allmighty God in the presents of the Complainante (or Def.t if any)
(touching the truth or remembrance of their knowledg or anything that may relate to the Cause
aforesaid and that redeucing the Severall Depositions into Writing you send the same
together with this our Commission under Your or any three or two of your hands to
us to our County Court of Somrset with all Convenient Speed Wittness Sam.ll Hopkins
Gent.m Chief Justices of our said Court the twenty Second day of August In the
sixteenth year of our Dominion &.c  Ann Dom one thousand seven hundred and
thirty   On the Backside of the foregoing Commission it was thus Endorsed viz.t
Two of the within Commission viz.t James Martin and James Rownd was
Qualified According to Law this 18.th day of 7.br 1730/1 before me   Sa: Hopkins

    Now hereat this day to witt the Sev^en^teenth day of March One thousand Seven hundred and thirty Came here into Court
James Rownd and James Martin of Somerset County Gent and two of the Commissioners above Nominated and made
Return of the foregoing Commission and the following affidavitts to the Same Commission annexed viz.t

                In Obediance to a preceipt hereunto annext we James Martin and James Rownd having Given due
notice we met the Seventeenth day of October 1730 on that tract of Land of Edward Davis called Gudenbourough
and in the presents of the Comp.t (no Defend.t appearing) came William
Simpson an Evidence Aged about forty five years and being Sworn on the Holy Evangelist
of Almighty God Saith that about fifteen years agon his father Walter
Evans told him that there was a marked white oak tree Standing and now Stands
at the head of Silver Street Drean which said tree is Standing to the Eastward
of a pond called Silver Street pond which said tree he was Desired on William
would haves death bed to Show to the Surviving Heirs and According to the said Evans
Information this Depon.t Search and found a tree so marked and so Standing but
whether it be the first Bound.r of Harmansons Land he can't say and further
saith not
the same day also came Andrew Smith an Evidence aged about fifty Nine and Being sworn
on the Holy Evangelist of Allmighty God saith that in a round swamp about one hundred
and fifty yds from Hodges Evidence below Mentioned toward W.m Griffins plantation
that Christian Harmanson and old James Bratton about twenty four years agon came
to his house and Christian Harmanson told him that would have was a going to Lay of
the Land from him that he had bought of him and Deser'd this Depon.t to assist him
in Carrying the chain accordingly he wont and they began in the round swamp above
mentioned fronting the Savanna Read and from thence they run some courses and
run down a Gully between two old fields and that in that round swamp there stood a
marked white oak which the depon.t took to be the first Bounder of Harmansons
Land and old Andrew Miller told this depont that would have was very foolish and blame
worthy to brake his Land so in Selling that piece of Land to the Eastward of the Gully
and would have on his death bed Desired his Ex.rs and admrs George day and Walter
Evins to come to this Depon.t and he would show them the said Bound.r and Division
between him and the said Harmanson but never came and further the said Depon.t
Declared that they run down ye aforesd Gully and branch to the fork of the main
Branch and would have said you must go no further for ever the branch belonged to
M.r James Rownd which then was in the possesion of Edgar and further the said
Deponant saith that in that fork of the said Branch there then stood and now
stands a marked read oak which is a bound.r of Harmansons Land and further
saith not
Also Rob.t Hodge the same day came as an Evidence aged about fifty odd and Being sworn
