1730 60 Rain and as to clearing of Land and cuting of timber we doe not think it proper that there should be any Excepting a small cornfield on the Like and Nessesary timber to be cut for the Repairing of the plantation and as to the rent of the plantation we value it to teen shillings p year and no more Richard Hickman George Howard
Whereupon the Said Aristobus Christopher being Called appears and thereupon the Said Aristobulus at the prayer of the aforesaid John Stewart by his attorney is adjudged to give Speciall bail to the action aforesaid whereupon a Certain Heber Whittingham of Somerset County Gent.m present herein Court undertakes for the Said Aristobulus that if in Case the Said John Stewart Should recover Judgm.t in the plea afd against the afd Aristobulus or that the said Aristobulus Should be therein Convict that then he the Said Aristobulus Shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that they he the Said Heber Whittingham will do it for him thereupon the Said Aristobulus by James Shirley his attorney appears & Imparles till next Court &c
Merch.t if they Shall be found in your bailywick to the Value of Eighty four pounds three Shillings and eight pence Sterling mony and Seventeen hundred pounds of tobacco and when You have the Same attached or any part thereof the Same in Your Custody Safe keep so that You have the Same before Our Justices of our county Court to be Held at Dividing Creek the third tuesday of March Next then and there to be condemned According to act of assembly to and for the use of a Certain James Donnelson unless the said George Martin by himselfe or his Attorney Shall appear and answere unto the said James Donnelson in a plea of trespass upon the case &.c According to Law and that by Good and Lawfull men of your Bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before the Justices of our county Court to be held as afd to Shew cause if any he she or they have why the same Goods Chattles ^rights or Creditts^ so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to the form of the Act of Assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place afd and have you then and there this writt wittness W.m Planner Gent.m one of our Justices of our s.d Court the twenty forth Day of November in the sixteenth Year of our Domrn &.c Anno Dom one thousand seven hundred and thirty Att which Said third Tuesday of March to witt the Sixteenth day of the Same month Ann.o Dom One thousand seven hundred and thirty Co being the day of the Return of the Said Writt Cometh the Said James Donelson by his attorney afd and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t By vertue of the within Writt to me directed I have attached twenty five thousand Seven hundred pounds of tobacco as the Goods and Chattells of |
