Confesseth to be true prays Judgment and those Damages above Confessed together
with his Costs and Charges afd to him adjudged &c         Therefore by Consent
of the parties aforesd it is Considered that the afd John Fleming Recover against
against the Said Will.m Smith his Damages aforesd to the aforesd five pounds
ten Shillings by the Same Will.m Smith in forme afd Confessed as also
283   Two hundred & Eighty three       pounds of tobacco for his Costs and Charges afd
to the Same John at his request by the Court here and Consent of the parties
aforesd adjudged &c and the afd Deft in Mercy &c

Somerset ss  John Evans Late of Somerset County planter was attached to answer
unto James Simm's of a plea of trespass upon the Case &c
And whereupon the Said James by Thomas Bluett his Attorney
Complains that when the Said John the third tuesday of May in the Year of our
Lord one thousand seven hundred and twenty Six at Somerset County aforesd
was Indebted to the Said James in the Sum of three pounds Eighteen
Shillings and four pence Current Money of Maryland for divers goods and
Marchandizes to the Said John by the Said James at the Speciall Instance
and Request of him the Said John before that time Sold and Delivered and
being so thereof Indebted the Said John in Consideration thereof afterwards
to witt the day and year aforesaid at Somerset County afd and within
the Jur of this Court upon himself did assume and to the Said James
then and there faithfully promise that he the Said John the said three
pounds Eighteen Shillings and four pence to the said James when he
should be thereto required well and faithfully would pay and Content
Nevertheless the Said John his promise and assumption aforesd in forme
afd made No ways Regarding but desiging and fraudulently Intending
the Said James in this part to Deceive and Defraud the Said three
pounds Eighteen Shillings and four pence or any part thereof to the
Said James hath not paid or any ways Satisfied altho this to do the said Jn.o
afterwards to witt the Second day of May in the year aforesd at Somrset
County aforesaid by the Said James was required but the Same to him to
pay or Satisfie hath hitherto altogether Refused and Still doth refuse to
the Damage of him the Said James ten pounds Current Money and
thence he bringeth Suit &c                      Pledges &c Jno Doe  R Roe
