235 by the Same William in manner and form aforesaid above pleaded and the matter in the Same Contained are altogether Insufficient in the Law to the afd Joseph of his action aforesaid against the Same William to have and preclude &c Whereupon the Said Joseph ^prays^ that the Said William may rejoyn to his replication afd tentered upon the Country thereupon it is said by the Court unto the said William that he rejoyn to the replication of the aforesaid Joseph at his perill but the Said William Altho' Solemnly Called came not but made default whereby the Same Joseph remaineth against the aforesd William thereof undefended &c Therefore it is Considered that the aforesaid Joseph Jones recover against the afd William Shipham his debt aforesaid and his damages by Occasion of the detaining of 557 the Same debt to Five hundred & fifty Seven pounds of tobacco to the same Joseph by the Court here of his assent adjudged and the aforesaid defend.t in mercy &c whereupon the Said Wm Shipham by his attorney afd prays an appeal from the Judgmt afd before the Justices of the provincial Court which is Granted &c
Attorneys of the County Court of the right Honrble the Lord p.ry here present herein Court in his own proper person of a plea of Debt the tenor of which bill follows in these words to the Justices of the Right Honrble the Lord proprietary of the County Court here now held for the County of Somrset Somrset County ss: John Stewart Jun by Francis Allen his Attorney Complains of James Shirley Gent one of the Attorneys of the County Court of the Right Honrble the Lord p.ry here present here in Court in his own proper person otherwise Called James Shirley of the AForesaid County and province of Maryland Gent for that the aforesaid James doth Unjustly detain and hath not rendered to the aforesd John Forty pounds Current Money of this Province which to him he oweth for that whereas the aforesd James the Six^th^ day of Septemb.r Annoq.r Domini one thousand Seven hundred and thirty at the County of Somerset afd within the Jur of this Court by his Certain Writing obligatory aforesd did acknowledge himselfe to be bound unto the Said John in the aforesd forty pounds to be paid to the Said John when he Should be thereunto required yett the Said James tho' Often required the Said forty pounds to the Said John hath not rendered the Same to him hitherto to render hath Denyed and Still doth Deny and Unjustly Detaine to the Damage of the Said John of thirty pounds Money aforesd and thereupon |
