the Same Penelope not only in her good Name fame Creditt and esteem afd is greatly
hurt and injured and ^in^ her mind much disquietted but also great Sums of Tobacco
In Defence for the Manifestation of her Innocency in that part hath been obliged
and Compelled to Expend to the damage of the said Penelope fifteen thousand
pounds of Tobacco and thereof she bringeth Suit                                   Jn.o Doe

And the aforesd Thomas by Michael Howard his Attorney Cometh and Defendeth
the force and Injury when &c and prayeth Liberty of Imparling thereof here
untill the Second tuesday in June then Next folowing and he hath it and &c
the Same day is given to the aforesd Penelope here &c   Also

Att which day here Came againe the Parties aforesd by their Attorneys aforesd
and thereupon the afd Thomas Prayeth that the aforesd Penelope may give
Security for Cost to the aforesd Thomas in Case the Said Penelope be Convict
in the plea afd and thereupon day dureing this time is given by the Court
now here to the aforesd Penelope to give Security to the afd Thomas as afd and
it is Sayed unto the Said Penelope by the Court now here that She Security for
Cost as aforesd to the aforesd Thomas Dureing this terme Should give at her
perill                     And because that the aforesd Penelope now here nor at any
time During this time hath Given Security for Cost as the afd Thomas

Therefore it is Considered that the afd Penelope take Nothing by her writt
and Declaration afd but that She and her pledges of prosecuting be in mercy
and that the aforesd Thomas go thereof without day and further it is
Considred by the Same Court that the aforesd Thomas recover against the
aforesd Penelope one hundred forty and three pounds of Tobacco for his Costs
and Charges which he hath Sustained by occasion of the premisses afd unto
the same Thomas by the Court now here according to the forme of the Statute
in Such Case made and provided of his assent adjudged
