115 Christo^pher^ on the first Day of Novr in the Year aforesd and often afterwards at Somrset County aforesd within the Jurisdiction aforesd he was thereunto requested hath not paid or to him for the Same in any Sort Content but the Same to him hitherto to pay or Content hath refused and Still doth Refuse and Deny to the Damage of the said Christopher of twelve pounds Money aforesd and thereupon he brings Suit &.c F Allen P Qere Pledges dep Jno Do Ri Roe And the afd William Whittington by Levin Gale his attorney Cometh and defendeth the force and Injury when &.c and prayed Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd plft there also Att which Said next Court to witt the Sixteenth day of march anno Dom One thousand Seven hundred and thirty Came againe as well the afd Christopher as the afd William by their attorneys afd and whereupon the said William prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid plft there also &c Att which Said next Court to witt the fifteenth day of June anno Dom One thousand seven hundred and thirty One Came againe as well the afd Christopher as the afd William by their attorneys afd and whereupon the Said William prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd Christopher here also &.c Att which Said next Court to witt the Seventeenth day of August Ann Dom One thousand Seven hundred and thirty One Came againe as well the afd Christopher as the afd William by their attorneys aforesaid and whereupon the Said William as before defends the force and Injury when &c and Saith that he hath not assumed upon himselfe in manner and form as the aforesaid Christopher above against him hath Complained and thereof he putts himselfe upon the Country And the plft in like manner Whereupon the afd William by his attorney aforesaid and relinquisheth his Verification afd by him ^first^ above pretended Says that he Cannot Gainsay the action aforesaid of the afd Christopher nor but that he did assume upon himselfe in manner and form as the afd Christopher above against him hath Complained and as to the damage of the Same Christopher by him by Occasion of the premisses in that part Sustained the Same William Says and Confesseth that the aforesaid Christopher Sustained damages by Occasion of the premises further than his Costs and Charges by him about his Suit in that part apposed to Six pounds Currant money of Maryland and not more and because the afd Christopher denyes not this but the Same allegation Confesseth to be true prays Judgmt and those damages first above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties afd it is Considered that the afd Christopher Glass Recover against the aforesaid William Whittington his damages aforesaid to Six pounds Currant money 295 of Maryland by the Said William in form afd Confessed as also Two hundred & Ninty five pounds of tobacco for his Costs and Charges the Same Christopher at his request by the Court here and Consent of the parties afd adjudged & the afd deft in Mercy &c |
