And the afd Jno Bishop Jun.r by Geo: Dashiell his attry Comes & Defends the force and Injury when
&a   And prays Leave to Imparle hereunto untill ye Next Court and he hath it and the same
Day is given unto ye afd Plft here also &a

Att which said Next Court to witt ye fifteenth day of August Anno Dom one thousand seven
hundred & twenty seven Came again as well ye afd Francis Allen as the afd Jn.o Bishop Jun.r by
their attrys afd and whereupon the afd said Jn.o Bishop by his said attry as before Defends the
force & Injury ^when^ &a   And says yt he Cannot gainsay ye action of ye afd Francis nor but yt ye Writing
Obligatory afd is ye act & Deed of ye Same John nor but yt he owes ye afd Francis the afd Eight Thousand
pd.s of Tob.o in Manner & form as ye afd Francis above against him hath Declared &a

    Therefore it is Considered by ye Court here yt ye afd Francis Allen Recover against the
afd Jn.o Bishop Eight Thousand pd.s of Tob.o his Debt afd & his Dam.s by Occasion of ye detaining
350   of ye Same Debt to three hundred and fifty                               pounds of Tob.o to ye same
Francis of his assent by ye Court here adjudged & ye afd Deft in Mercy &a
                                           Charge fees to Capt Bone

Abraham Smith of Somersett County Planter was somoned to answer
unto Francis Allen of a plea that he render unto him Eight thousand
       pounds of tob.o which to him he Owes and Unjustly Detaines &c

           And Whereupon the same Francis by Levin Gale his attorney saith that
       whereas the afd Abraham the twenty sixth day of Novem Anno Dom one thousand seven
       hundred and twenty six at Somersett County within the Jurisdiction of this Court by his
       Certain writing obligatory Granted himselfe to be held and firmly Bound unto the same
       Francis in the sum of Eight thousand pd.s of tob.o to be paid the same Francis when afterwards
       the said Abraham should be thereto required Yet the afd Abraham tho' often then
       Required the said Eight thousand pounds of tobo to the same Francis hath not rendered
       but the said Abraham the same hitherto to do hath altogether Denyed and still doth deny
       and Unjustly Detaine where by the same Francis says he is worse and hath Damage
       to the value of sixteen thousand pounds of tob.o and thereof he brings this suite
       and the same ^francis^ Brings hereunto Court the writing obligatory afd with the Debt afd
       in form afd   Wittnesseth whose Date in the same day & Year afd &c
